In November 2020, a number of changes to the ASEAN Cosmetics Directive Annex II (Prohibited Substances), Annex III (Restricted Substances) and Annex VI (Authorized Preservatives) were published. These changes were adopted at the 32nd ASEAN Cosmetics Committee (ACC) meeting held on September 29-30, 2020.
The ASEAN Cosmetics Directive is similar to the EU Cosmetics Regulation but needs to be transposed to national law. To this effect, some differences may exist in the regulatory status of substances between the ASEAN countries (Brunei, Cambodia, Indonesia, Laos, Malaysia, Myanmar, Philippines, Singapore, Thailand and Vietnam).
Annex II is updated by the addition of four substances – Dibutyltin hydrogen borate, Formaldehyde, Paraformaldehyde, and Methanediol. The use of Formaldehyde is prohibited in all ASEAN countries except Laos PDR, Thailand and Vietnam. These three countries will still permit the use of Formaldehyde in nail hardening products at a maximum concentration of 2.2%. For these countries, the restriction is reflected in Annex III. The implementation date for these amendments is March 8th 2022, except for Dibutyltin hydrogen which takes effect on September 8th, 2021.
Annex III is amended to include Tagetes erecta flower extract/oil with restriction for use of 0.01% in leave-on products and 0.1% in rinse-off products. These limits apply also to the combined use of Tagetes minuta and Tagetes Patula flower extracts/oils with Tagetes erecta flower extracts/oils in products.
Annex VI is amended by removing the entry for Formaldehyde and Paraformaldehyde since now these substances are prohibited (with the exception of Formaldehyde for Laos PDR, Thailand and Vietnam).
UL’s LOLI database is being updated to reflect the Amendments and will be available for the January 2021 (2021-1) release.
