On December 18, 2018, the Office of Pipeline Hazardous Materials Administration (PHMSA) issued a Notice of Enforcement Policy Regarding International Standards.
The Notice was issued because HM-215O, the final rulemaking adopting the International Standard for the transport of Hazardous Materials, has not been issued.
What is contained in the PHMSA notice?
The Notice allows offerors and carriers of Dangerous Goods in International transport to continue to use the 2017-2018 edition of the ICAO (International Civil Aviation Organization) Technical Instructions and the IMDG (International Maritime Dangerous Goods) Code Amendment 39-16 until such time as PHMSA decides to adopt the 2019-2020 edition of the ICAO Technical Instructions and Amendment 39-18 of the IMDG Code.
This Notice of Enforcement Policy Regarding International Standards in effect means that PHMSA will not take enforcement action against any offeror or carrier who is using the existing 2017-2018 edition of the ICAO Technical Instructions for Shipment by air and Amendment 39-16 of the IMDG Code.
