U.S. PHMSA Issues Final Rule Providing Revisions to Civil Penalty Amounts

On November 27, 2018, the Office of Pipeline Hazardous Materials Administration (PHMSA) issued RIN 2105-AE70, which is a final rule addressing Revisions to the Civil Penalty Amounts.

This final rule implements the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 and is effective as of November 27, 2018.

What is covered in Final Rule RIN 2105-AE70?

The final rule covers Inflation Adjustments for Civil Penalties for the various branches of the U.S. Department of Transportation (U.S. DOT).

The previous maximum Civil Penalty possible was $78,376, and has now increased to $79,976.

The existing maximum Civil Penalty for a hazardous materials violation that results in death, serious illness, or severe injury to any person or substantial destruction of property was $182,877. This has now increased to $186,610.
